Own a piece of land for non-Saudi

I would like to be consulted regarding the non-Saudi ownership of a piece of land in Jeddah Can I legally register it in my name? Thank you very much.

In response to your question about the possibility and method of owning a piece of land in the city of Jeddah, we inform you the following:

 

First: – Non-Saudi may own a housing unit within the Kingdom of Saudi Arabia in accordance with the rules stipulated in the non-Saudi ownership of real estate and investment system issued by Royal Decree No. M / 15 dated 17/4/1421

 

The system has divided the ownership of persons in Saudi Arabia into two parts:

A: Investor ownership

 

Paragraph (a) of Article (1) of the Law stipulates that a non-Saudi investor who is a natural or juridical person licensed to engage in any professional, artisanal or economic activity may own the real estate necessary for such activity, including the real estate necessary for his residence and the residence of his employees.

 

The investor may also purchase buildings or lands to build buildings and invest them by selling or leasing, provided that the total cost of the project land and construction is not less than SR 30 million.

 

The Council of Ministers may amend this amount as stipulated that the real estate shall be invested within five years of its ownership, as stipulated in paragraph (b) of Article 1 of the same Law.

B: Persons of natural character and they are as follows:

 

1- Residents of the Kingdom of Saudi Arabia.

 

The said system allows non-Saudi residents residing in the Kingdom under a legal residence, to own a property for the purpose of private housing (apartment), after obtaining the approval of the Saudi Ministry of Interior, in accordance with Article 2 of the same system, note that the person in this case may not rent his own housing owned by To others.

 

2- Non-residents of the Kingdom.

 

Where the system mentioned in its fourth article on the permissibility of ownership of private housing subject to obtaining approval from the Prime Minister.

 

3- Non-Saudi resident or non-resident.

 

Such acquisition shall be by inheritance, in which case no approval from the Ministry of Interior or the Prime Minister shall be required, as provided for in Article 5 of the Law.

Exceptions.

 

Prohibit the non-Saudi ownership (whether moral or natural) of any real estate inside the Kingdom of Saudi Arabia, including the cities of Makkah and Madinah, except where ownership, right of easement or usufruct through legal inheritance

Second:- The Royal Decree No. M / 8 dated 15/02/1422 AH stipulates that GCC nationals who are natural persons shall be allowed to own real estate within the limits of three properties in the residential areas of any Member State, provided that the total area does not exceed 3,000 square meters. If the property is land, the owner must complete its construction within six years from the date of its registration in his name. The State may extend that period in the conviction of the reasons for the delay of the owner in the construction. The property is a transferable property only four years after the date of registration Exemptions may be made before the expiry of that period after obtaining prior permission from the competent authorities.

If the applicant wishes to acquire the nationality of the Member States by naturalization and is not originally a GCC national, the State concerned may require a period not exceeding five years for its naturalization.

Based on the above… .. we answer the question that the non-Saudi is entitled to own property (land in the city of Jeddah) in the event of any of the following cases:-

 

1- Non-Saudi should be a foreign investor within the Kingdom of Saudi Arabia, or come to Saudi Arabia as a foreign investor

 

2- That the non – Saudi heir is legitimate.

 

 3- The non-Saudi citizen must be a GCC citizen.
